Public Offer Agreement

1. General Provisions
This Public Offer Agreement (“Offer”) constitutes a legally binding agreement between the user (“User”, “Pilgrim”) and Ihram App (“Platform”).
By creating an account, booking a tour, or making a payment through the Platform, the User accepts this Offer in full.
Acceptance of this Offer creates a binding agreement in electronic form.
2. Role of the Platform
The Platform is a digital technology service that:
- Provides tour listings from independent tour operators
- Enables booking and communication
- Facilitates escrow-based payments
- Provides trust scoring and analytics tools
The Platform is NOT:
- A tour operator
- A travel agency
- A transportation provider
- An insurance company
All travel services are provided directly by the Tour Operator.
3. Formation of Travel Contract
When a booking is confirmed, a separate travel services agreement is formed directly between the User and the Tour Operator.
The Platform is not a party to that agreement.
4. Booking & Confirmation
Bookings are subject to:
- Operator confirmation
- Availability
- Visa and regulatory requirements
A booking is considered valid only after confirmation by the Operator.
5. Payments & Escrow
Payments may be processed through escrow mechanisms.
- Funds may be temporarily held until booking confirmation
- Funds are released to the Operator according to Escrow Policy
- The Platform does not use escrow funds for its own purposes
Service fees charged by the Platform are separate from the tour price.
6. Cancellations & Refunds
Refund conditions depend on:
- The Operator’s cancellation policy
- Time remaining before departure
- Third-party service providers (airlines, hotels, visas)
The Platform does not make final refund decisions but may facilitate communication.
7. Umrah & Hajj Specific Conditions
The User acknowledges that Umrah and Hajj services are subject to:
- Saudi Arabia (KSA) regulations
- Visa approval processes
- Quota restrictions
- Religious compliance rules
Visa rejection or government restrictions do not automatically create Platform liability.
8. Limitation of Liability
To the maximum extent permitted by law, the Platform shall not be liable for:
- Operator failures
- Flight delays or cancellations
- Visa denials
- Hotel changes
- Health incidents
- Force majeure events
Platform liability, if any, is limited to the amount of Platform service fees.
9. User Obligations
The User agrees to:
- Provide accurate information
- Comply with visa requirements
- Follow Operator instructions
- Respect religious and local laws
10. Dispute Resolution
Disputes regarding travel services must first be addressed to the Tour Operator.
The Platform may assist as a mediator but is not obligated to resolve disputes.
11. Data Processing
Personal data is processed in accordance with the Privacy Policy.
12. Amendments
The Platform may update this Offer at any time. Continued use constitutes acceptance of updates.
13. Governing Law
This Offer is governed by the laws of the Republic of Kazakhstan.
